JUST FOR CLARITY, STAFF TYPICALLY AND I BELIEVE WILL BE PRESENTING ON THE MILLAGE RATE, THE OPERATING BUDGET, AND PAY PLAN AND THE COMMUNITY INVESTMENT PROGRAM PRESENTATION. SCOTT REYNOLDS, TOWN OF JUPITER FINANCE. AS YOU'VE JUST INDICATED, THIS IS THE FIRST OF TWO PUBLIC HEARINGS ON THE BUDGET. WE'VE HAD A LONG SUMMER. STARTING IN JUNE, WE HAD A WORKSHOP ON THE TOWN'S OPERATING BUDGET. IN JULY, THE COUNCIL SET THE TRIM RATE TO BE NOTICED TO THE PUBLIC, AND THEN ON AUGUST 11TH, WE HAD A WORKSHOP REGARDING THE TOWN'S COMMUNITY INVESTMENT PROGRAM. THE OBJECTIVES FOR THE BUDGET AND ASSUMPTIONS WAS TO STRUCTURE A PROPOSED BUDGET THAT ALLOWS FOR A FLAT MILLAGE RATE, WHICH WILL RESULT IN MODEST INCREASE FOR RESIDENTS AND BUSINESSES BASED ON PROPERTY VALUATIONS. AS WE'LL DISCUSS THIS EVENING, THERE HAS BEEN SOME EXPONENTIAL INCREASES IN VALUES THIS YEAR OVER PREVIOUS YEARS. WE'VE DISCUSSED THAT AT LENGTH OVER THE SUMMER. WE'RE GOING TO MAKE ADJUSTMENTS IN OUR INVESTMENTS IN PUBLIC SAFETY, MAINTENANCE OF INFRASTRUCTURE AND LANDSCAPING THROUGHOUT THE TOWN. ALSO, ONE OF THE PRIORITIES IS OF COURSE, TO SUPPORT THE STRATEGIC PRIORITIES OF THE TOWN COUNCIL. WE'VE SHOWN THAT THROUGHOUT THE BUDGET, GAVE SUMMARY DOCUMENTS TO SHOW WHERE THOSE ITEMS ARE LOCATED WITHIN THE BUDGET, AND HOPEFULLY TO MAINTAIN OR ENHANCE THE LEVELS OF SERVICE TO THE CITIZENS OF THE TOWN. SOME OF THE ASSUMPTIONS WHEN WE PUT TOGETHER THE BUDGET IN REGARDS TO THE AD VALOREM PROPERTY TAX REVENUES THAT THEY'RE HIGHER THAN FY-22 DUE TO INCREASES IN PROPERTY VALUES AND NEW CONSTRUCTION. WE ALSO HAD SOME SALARY ADJUSTMENTS. THE COUNCIL HAS TALKED AT LENGTH ABOUT THIS DURING MULTIPLE WORKSHOPS ABOUT SALARY ADJUSTMENTS FOR COUNTY EMPLOYEES, PRIMARILY TO ASSIST THEM DURING THESE TIMES OF HIGH INFLATIONS THAT HAVEN'T BEEN SEEN IN OVER 40 YEARS, AND ALSO TO STAY COMPETITIVE IN THE AREA MARKET. THE FIRST ITEM THAT WE'RE GOING TO BE DISCUSSING THIS EVENING IS THE MILLAGE AND THE TRIM RATE, AS WELL AS THE ROLLBACK RATE, BUT LET'S START WITH THE HISTORICAL VALUATION. WE'VE SEEN THIS CHART A NUMBER OF TIMES THROUGHOUT THE SUMMER. YOU CAN SEE THE EXPONENTIAL GROWTH IN FY-23 REGARDING THE 13.11 PERCENT INCREASE IN VALUES THROUGHOUT THE TOWN. [00:05:03] WHAT THAT'S MADE UP OF, WHEN YOU COMPARE IT TO FY-22, YOU'VE GOT 1.4 BILLION DOLLARS OR 12.2 PERCENT IN VALUATION INCREASES IN 136 MILLION DOLLARS IN NEW CONSTRUCTION, JUST OVER ONE PERCENT OF THE 13.11. THAT'S PRETTY SIGNIFICANT TO NOTICE WHEN YOU COMPARE US TO OTHER COMMUNITIES. WE'VE TALKED ABOUT THAT AT LENGTH THROUGHOUT THE SUMMER AS WELL. DOING THOSE COMPARISONS WHEN WE'RE AT BUILD-OUT, ONE PERCENT IS FOR NEW CONSTRUCTION, THE REST IS VALUATION. THAT'S THE SALE OF THE HOMES AND THE PROPERTIES THAT HAVE BEEN RECURRING OVER THE LAST COUPLE OF YEARS IN THE TOWN OF JUPITER. TALKING ABOUT THE ROLLBACK RATE, THE ROLLBACK RATE IS TO BRING IN THE SAME AMOUNT OF DOLLARS. WHAT WOULD THAT MILLAGE RATE LOOK LIKE TO LAST YEAR? WHEN YOU DO THE COMPARISON OF THE ROLLBACK RATE TO THE PROPOSED MILLAGE RATE OF 2.4633. WE'RE BRINGING IN JUST OVER 3.4 MILLION DOLLARS MORE THAN THE ROLLBACK RATE WOULD BRING IN. IN REGARDS TO THE SUMMARY OVERVIEW OF THE BUDGET, THE PROPOSED FY-23 OPERATING BUDGET REPRESENTS A 12.2 MILLION DOLLARS INCREASE OVER FY-22. THAT EQUATES TO A SEVEN MILLION DOLLAR INCREASE IN THE GENERAL FUND PRIMARILY DUE TO SALARY INCREASES. THE INFLATIONARY SUBSIDY THAT WE'VE BEEN DISCUSSING FOR EMPLOYEES, THERE'S A LARGE CAPITAL TRANSFER FOR FURNITURE AND FIXTURES IN REGARDS TO THE NEW TOWN HALL, AND THEN OF COURSE, THE SOLID WASTE INCREASES, WHICH IS PRIMARILY A PASS-THROUGH AND REVENUES AND EXPENDITURES EQUAL EACH OTHER. ALSO A 22 MILLION DOLLAR DECREASE IN THE COMMUNITY INVESTMENT PROGRAM, WHICH IS PRIMARILY DUE TO THE NEW PROJECT FUNDING OF OVER 18 MILLION DOLLARS IN FY-22 WAS FOR THE NEW TOWN HALL THAT WAS BUDGETED IN FY-22. IT LOOKS LIKE THERE'S A REDUCTION OVERALL. ALSO THE FUNDING OF THE HEALTH INSURANCE BENEFITS FOR VACANT POSITIONS PRIMARILY IN PREVIOUS YEARS. IF THERE WAS A VACANCY, WE DID NOT FUND THE HEALTH INSURANCE PORTION OF THAT. WE HAVE SINCE STARTED DOING THAT. AGAIN, WE'VE DONE IT IN THE PAST AND WE'VE JUST RESTARTED THAT PROGRAM BECAUSE WE ARE ACTIVELY FILLING VACANCIES. ALSO, THE COUNCIL HAS VOTED ON A 7.5 PERCENT WATER RATE INDEXING INCREASE, AND THIS IS PRIMARILY DUE TO INFLATIONARY PRESSURES AND A SEVEN PERCENT RATE INDEX FOR STORMWATER. AGAIN, DISCUSSING THE GENERAL FUND REVENUES, THERE'S A 13.11 PERCENT INCREASE IN ASSESSED VALUES FOR A TOTAL OF JUST OVER THREE MILLION DOLLAR INCREASE IN AD VALOREM REVENUES COMING INTO THE GENERAL FUND OVER THE PREVIOUS YEAR. THERE'S A SLIGHT INCREASE IN UTILITY TAX REVENUE, INTERGOVERNMENTAL REVENUES IS ALMOST 0.5 MILLION DOLLARS DUE TO SALES TAX REVENUE AND STATE REVENUE SHARING. AS WE DISCUSSED DURING THE WORKSHOPS, WE ACTUALLY SAW SOME REDUCTIONS IN SOME OF THOSE AND WHAT WE WOULD NORMALLY ANTICIPATE IN AN AREA OF GROWTH AS FAR AS THE SALES TAX AND STATE SHARED. WE'VE ACTUALLY DID NOT MEET WHAT I WOULD CONSIDER THE EXPECTATION OF GROWTH GOING FORWARD IN THE NEXT YEAR. THE SOLID WASTE INCREASE OF 2.2 MILLION DOLLARS. AGAIN, THAT'S A PASS-THROUGH BETWEEN THE REVENUES AND EXPENDITURES. ALSO, THERE'S A USE OF FUND BALANCE, AS YOU CAN SEE HERE. THIS COMES DIRECTLY FROM THE LAST WORKSHOP THAT WE HAD PRIMARILY DUE TO AN INCREASE IN THE SALARIES FROM A FOUR PERCENT INCREASE BASE SALARY, INCREASE TO A FIVE PERCENT INCREASE IN SALARIES, SO AN ADDITIONAL ONE PERCENT. ON THE EXPENDITURE SIDE OF THE HOUSE GAVE A SUMMARY DOCUMENT JUST TO SHOW THE 6.9 MILLION DOLLAR INCREASE OVER THE PREVIOUS YEAR, WHICH IS VERY SIGNIFICANT. THE PRIMARY DRIVER OF THAT IS AGAIN, THE SOLID WASTE INCREASE, 32 PERCENT OVER LAST YEAR. ALSO THE NEW TOWN HALL FURNITURE AND FIXTURES TRANSFER AND SALARY AND OVERTIME INCREASES AND BENEFITS. FOR THE WATER FUND, THERE'S A 7.5 PERCENT WATER RATE INDEXING THAT'S BEEN PREVIOUSLY APPROVED BY THE COUNCIL. ALSO, IT'S 105 PERCENT OVER THE LAST YEAR, THE REVENUE DUE TO CUSTOMER DEMAND AND RATE INDEXING FOR INFLATION. ALSO, IT ASSUMES A ONE PERCENT GROWTH IN CUSTOMERS. ON THE EXPENSE SIDE, FIVE PERCENT SALARY INCREASES AND A 2,800 INFLATIONARY SUBSIDIES FOR EMPLOYEES THAT'S THROUGHOUT THE TOWN, NOT JUST THE WATER FUND. ALL FUNDS WILL RECEIVE THAT. [00:10:01] THERE'S A $3.6 MILLION INCREASE IN COSTS FOR OPERATING PRIMARILY DUE TO INFLATION AND SUPPLY CHAIN ISSUES. AN INCREASE IN $159,000 IN UTILITY SERVICES PRIMARILY DUE TO THE FPL RATE INCREASE AND CHEMICAL COSTS. WE'VE BEEN TALKING ABOUT THAT THROUGHOUT THE SUMMER. THAT'S A 1.9 PERCENT INCREASE, 196 PERCENT. THAT'S QUITE SUBSTANTIAL. THAT'S NOT JUST THE TOWN OF JUPITER, THAT'S ALL UTILITIES THROUGHOUT THE STATE OF FLORIDA. FOR THE STORMWATER FUND, THE COUNCIL HAS PREVIOUSLY APPROVED A SEVEN PERCENT RATE INDEXING INCREASE, ONE PERCENT IN CUSTOMER GROWTH. ALSO EXPENSES OF FIVE PERCENT SALARY INCREASE AND THE 2,800 SUBSIDY FOR EMPLOYEES TO DEAL WITH INFLATIONARY PRESSURES THAT WE'RE FEELING. PLUS JUST OVER $96,000 IN REPAIRS AND MAINTENANCE COSTS INCREASED. THE BUILDING FUND. THE BUILDING FUND THEY'RE STILL EXPERIENCING GROWTH IN THEIR REVENUE IN THEIR BUILDING PERMITS. FOR FY23, WERE SEEING OR RECOGNIZING A $600,000 INCREASE PRIMARILY DUE TO THE PERMANENT REVENUE. WE'RE ANTICIPATING BY THE END OF FY22 THAT WE WILL EXCEED OVER FIVE MILLION DOLLARS AS WELL. WE'RE SHOWING $585,000 DESIGNATED FROM RETAINED EARNINGS. THAT'S PRIMARILY DRIVEN BY THE TRANSFERS, THE NEW TOWN HALL FURNITURE, AND FIXTURES, AND WE'VE DISCUSSED THE TELEPHONE SYSTEM AND THE IT MEANS THAT ARE OCCURRING OVER THERE DIRECTLY RELATED TO THE BUILDING FUND. ALSO, THERE'S A FIVE PERCENT SALARY INCREASE AND THE $2,800 INFLATIONARY SUBSIDY, BUT THE PRIMARY DRIVER'S SALARY INCREASES, AND THEN THE CAPITAL TRANSFERS IN RELATION TO THE INCREASE IN FY23 OVER FY22. THE CIP FUND, IS JUST A SNAPSHOT. WE JUST HAD A WORKSHOP ON THAT A COUPLE OF WEEKS AGO. THE FY23 AMOUNT IS OVER $45 MILLION. THE TOTAL CIP OVER THE FIVE-YEAR WINDOW IS JUST OVER $108 MILLION FROM FY23 TO 2027. IN SUMMARY, WHAT STAFF IS SEEKING IS APPROVAL ON THE FIRST READING OF THE PROPOSED OPERATING MILLAGE RATE OF 2.4633, AND THE DEBT SERVICE RATE OF 0.1501 THROUGH ORDINANCE 10-22. ALSO SEEKING APPROVAL ON FIRST READING OF THE PROPOSED COMMUNITY INVESTMENT PROGRAM THROUGH ORDINANCE 9-22 AND OF COURSE, ANY DISCUSSION OR QUESTIONS REGARDING RESOLUTIONS 82-22, THEY'LL BE COMING BACK ON SECOND READING FOR A VOTE THEN. THERE ARE COMMITMENTS THAT THE TOWN HAS MADE IN WRITING THAT DO NOT HAVE SIMILAR MONETARY COMMITMENTS. THE AREAS IN THE STRATEGIC PLAN, SPECIFICALLY OUR SAFETY, MOBILITY, AND SMALL TOWN FEEL. I'M GOING TO GO THROUGH A COUPLE OF EXAMPLES. THERE'S A PLAN TO WIDEN INDIAN TOWN ROAD BETWEEN CENTRAL BOULEVARD AND ISLAND WAY. THERE'S NO MENTION OF ANYTHING THAT CAN BE DONE TO REDUCE COMPLEXITY OF THE BUILT ENVIRONMENT ON THIS HIGH-SPEED ARTERIOLE, IS IT POSSIBLE TO REMOVE THE STOPLIGHT AND RESTRICT LEFT TURNS AT JUPITER WEST PLAZA? IS IT POSSIBLE TO LIMIT BUSINESS ACCESS TO THE SIDE STREETS? ARE THERE ANY OTHER WAYS TO REDUCE CONGESTION? IS IT REALLY EASIER TO COLLECT FOUR MILLION FROM THE JUPITER RESIDENT AND FIVE MILLION FROM THE FLORIDA TAXPAYER FOR THIS IMPROVEMENT. NEXT EXAMPLE, THERE'S A PLAN TO EXTEND THE EASTBOUND TURNING LANE ON JUPITER PARK DRIVE, AMONG OTHER ENHANCEMENT. WILL A LONGER TURNING LANE REALLY MAKE THE INTERSECTION SAFER AND REDUCE CONGESTION? WOULD A TURBO ROUNDABOUT BE A BETTER MODIFICATION TO THIS INTERSECTION? I'M SURE ANY RESIDENT WOULD APPROVE OF 76 PERCENT FEWER ACCIDENTS, REDUCED EMISSIONS FROM IDLING, LOWER MAINTENANCE COSTS, AND IMPROVED PEDESTRIAN SAFETY. THE BALLPARK IS, IF YOU TAKE A LOOK AT A HEATMAP OF FREQUENT TRAFFIC COLLISIONS IN JUPITER, YOU NOTICE A PATTERN. COLLISIONS ARE HAPPENING AT SIGNALIZED INTERSECTIONS AND LEFT TURN INTERSECTIONS AT AND ON HIGH-SPEED COLLECTOR ROADS. I DEFINE A HIGH-SPEED COLLECTIVE ROAD AS ONE WITH A SPEED LIMIT AT OR GREATER THAN 30 MILES AN HOUR, WHERE THE CHANCES OF A PEDESTRIAN FATALITY ARE GREATER THAN THE FLIP OF A COIN. I WOULD ASK THAT WHEN EVALUATING ROAD IMPROVEMENTS AND HOW TO SPEND THE LIMITED FUNDS AVAILABLE TO US, THAT YOU PLEASE CONSIDER SAFER ALTERNATIVES THAN THE STATUS QUO. I THINK OUR RESIDENTS AND BUSINESSES ARE GOING THROUGH SOME CHALLENGING TIMES AND THE COUNTY DID AND SOME OTHER LOCAL GOVERNMENTS HAVE, I REALLY FELT WE SHOULD AT LEAST REDUCE IT TO SOME AMOUNT. I'VE REALIZED THAT BROUGHT THAT UP AND THERE WAS NOT SUPPORT, BUT I CERTAINLY WANTED TO CONTINUE TO ADVOCATE FOR THAT. FROM AN OPERATING BUDGET STANDPOINT, AND I'M ASKING STAFF TO CONFIRM SCOTT ELM ABOUT TO ASK HERE. THE NET OPERATING BUDGET IMPACT OUR REVENUE FROM THE TAX INCREASE IS ABOUT 3.1 MILLION, WHICH MEANS THAT FOR A ONE PERCENT CHANGE IN MILLAGE RATE, IT'S ABOUT $235,000. MOST PUBLIC DON'T REALIZE THE SECOND LARGEST TAX REVENUE FOR GOVERNMENT IS REVENUES FROM FPL CUSTOMERS IN THE WAY OF FRANCHISE FEES AND UTILITY TAXES. I WAS TRENDING AND I'VE BEEN WORKING BACK-AND-FORTH WITH SCOTT ON THIS. I TYPICALLY USE A ROLLING 12 MONTHS. WE GET TO FISCAL REPORTS AND THEY GO THROUGH NINE MONTHS. BUT WHAT YOU MISS IS THE HIGHEST ELECTRICAL CONSUMPTION PERIOD OF THE SUMMER. THE PROPER WAY WHEN YOU HAVE SOMETHING SEASONALLY ADJUSTED IS TO LOOK AT A WHIRLING 12 MONTHS. SINCE THE RATE CHANGE TOOK EFFECT IN JANUARY THE REVENUES HAVE BEEN CLIMBING AT A PRETTY GOOD PACE. TO BUDGET, ASSUMPTION WAS A COMBINED $8.6 MILLION ON FRANCHISE FEES AND UTILITY TAX. I MEAN, I GOT THAT FROM THE DETAIL. AT THIS POINT IN TIME THROUGH JULY, THE 12-MONTH ROLLING AVERAGE IS OVER 8.9 MILLION. AGAIN, WE HAVE TWO READINGS. IF ANYBODY'S EVEN INTERESTED IN WHAT I'M TALKING ABOUT, IT'S SOMETHING OBVIOUSLY THAT STAFF BOTH HERE CAN COME BACK AND PROVIDE US WITH MORE INFORMATION. BUT BASED ON THE TREND, AND OF COURSE, FPL PASSES THROUGH FUEL COSTS. THAT ALSO TAKING INTO ACCOUNT FUEL COSTS. BUT IT'S CLEAR TO ME IN MY FAULT FINDING BECAUSE IT WAS STABLE FOR A NUMBER OF YEARS. BUT WITH THE RATE ADJUSTMENT AND INCREASED FUEL THAT FPL HAS, I THINK I CAN SEE US EASILY AT COLD MONTHS AT THE END OF SEPTEMBER, EVEN IF IT'S TWO MONTHS TO GO IT COULD BE OVER $9 MILLION OPINION. THEY RAN AS A FORM OF $1000 FINE, IF YOU WILL, WE HAVEN'T TAKEN INTO ACCOUNT, AND I THINK THAT'S CONSERVATIVE. THAT BEING SAID, THAT ONE ITEM. THEN I WANT TO JUST THROW THAT OUT THERE. I JUST WANTED TO MAKE SURE PEOPLE MAY NOT EVEN NOTICE THAT I DID INQUIRE ABOUT THAT. WHEN I PROPOSED SIX PERCENT I HAD THROUGHOUT A FOUR PLUS TWO PERCENT BECAUSE I WAS EXPECTING THAT THE RANGE IS WE'RE GOING TO MOVE FOUR PERCENT. THAT WAS WHAT I PROPOSED. YOU ALL STILL MAY NOT REALIZE DIFFICULT FOR COUNCIL TO WEIGH IN AND THEN IT JUST ONE PERSON AND IT DOESN'T GO ANYWHERE. I JUST WANTED TO SHARE THE PERSPECTIVE, AND AGAIN, WE HAVE TWO READINGS HERE. I'M NOT SEEING THAT COMING IN FROM THE STATE ESTIMATES, ACTUALLY SEEING A DOWNWARD TREND EVEN THOUGH THERE IS OBVIOUSLY AN INCREASE OVER THE PREVIOUS YEAR, BUT NOT AS MUCH AS WHAT THE TREND HAS BEEN. I'M SEEING THOSE CHANGES DAILY, SO I'M ANTICIPATING THAT THERE MIGHT BE EVEN ANOTHER DOWNWARD TREND FROM THE STATE. YOU DON'T KNOW, IT COULD HAPPEN. WHAT WE TEND TO REDUCE, WE STICK WITH, WE DON'T INCREASE OUR MILLAGE RATE VERY OFTEN WE HAD IT FLAT. WE DO HAVE ONE OF THE LOWEST MILLAGE RATES AND THE AREA EVEN COMBINED WITH FIRE, OURS IS 4.3, WELLINGTON, 5.9 DEL REY, 6.5, PALM BEACH GARDENS, 5.3. WE'VE KEPT OUR MILLAGE RATE FLAT AND WE DIDN'T HAVE 40 YEAR INFLATION DURING THAT TIME. NOW WE DO HAVE EXTRAORDINARY COSTS. [00:35:02] THE COSTS THAT WE SAW, THE 6.9 MILLION INCREASE OVER FY22. IT IS HARD FOR ME JUST WITH THE LEVEL OF UNCERTAINTY THAT WE'RE FACING. WE'RE VERY FORTUNATE TO HAVE THIS VALUATION INCREASE. THEY'RE COMMUNITIES I'M SURE THAT ARE FACING INFLATION AND OTHER STATES IN OTHER PARTS OF THE COUNTRY THAT DON'T HAVE THE EVALUATION THAT WE HAVE. THE INDICATIONS THAT I'M SEEING, LOOKING AT THE STATE REVENUE WHAT THEY'RE INDICATING TO ME IS THAT THEY'RE ANTICIPATING SOMETHING NEXT YEAR, WHAT THAT IS OR WHAT IT LOOKS LIKE. I DON'T KNOW. BUT LOOKING AT THE STATE SHARE AND THE SALES TAX REVENUE IS AN INDICATION OF SOME DOWNTURN IN ECONOMIC ACTIVITY. THAT IS MY ONLY CONCERN WHEN WE'RE LOOKING AT SPECIFICALLY THE MILLAGE, WHICH WAS OUR BIGGEST ITEM FOR OPERANT THAT SUPPORTS THE OPERATING. BUT I JUST WANTED TO REMIND. WE'VE TALKED ABOUT IT ALL SUMMER, WE'VE DISCUSSED THE MILLAGE AT LENGTH, LOOKED AT HISTORICAL TRENDS AND TALKED ABOUT LOOKING INTO THE CRYSTAL BALL, WHAT'S GOING TO HAPPEN NEXT YEAR OR THE NEXT FEW YEARS? REACHING OUT TO EVERY RESOURCE THAT I HAVE AVAILABLE TO ME. WHAT IS ANTICIPATED TO HAPPEN WITH THE MILLAGE, EVEN THOUGH WE'VE SEEN THIS LARGE INCREASE OF 13.11 PERCENT. IT'LL STILL BE HIGH, BUT THEN IT'S GOING TO EVENTUALLY GO BACK DOWN TO THAT NORMAL AMOUNT OF INCREASE ANYWHERE BETWEEN 4.5, 5 PERCENT POSSIBLY. BUT THEN WE HAVE NOWHERE TO GROW. THAT'S THE OTHER THING THAT WE'VE BEEN DISCUSSING THROUGHOUT THE SUMMER AS THE GROWTH WE'RE LOOKING AT, EVEN THOUGH WE'VE HAD A 13 PERCENT INCREASE, 12 PERCENT VALUATION, JUST OVER 1 PERCENT AND NEW CONSTRUCTION. IT APPEARED THE COUNCIL MEMBERS HAVE QUESTIONS ABOUT THE NEGOTIATION PROCESS THAT LED TO THE CURRENT STATE AND WONDERED WHAT WAS GOING ON AT LRD. I CAN ASSURE YOU WHAT IS GOING ON AT LRD IS LOGICAL, WELL-CONSIDERED, AND THE INTERESTS OF ALL OF YOU RATE PAYERS AND ITS MISSION. IN GENERAL, I FOUND THE TOWN COUNCIL'S DISCUSSION OF LRD POSITION DISAPPOINTING IN THAT IT WAS VOID OF ANY HISTORY AND CONTEXT OF PRIOR DISCUSSIONS BETWEEN THE TOWN AND LRD. IN FACT, IN BOTH THE TENANT'S REQUESTS TO CITE THREE NEW FLORIDAN AQUIFER WELLS ON LRD PROPERTY IN ADDITION TO THE TWO EXISTING SURFICIAL WELLS, WHICH IS OUR PROPERTY, AND ALSO THE TENANT'S REQUESTS TO EXTEND THE DISPOSAL OF THE TOWN'S NANO CONCENTRATE INDUSTRIAL WASTE. LRD OFFERED MODIFIED VERSIONS OF THOSE AGREEMENTS, WHICH WE BELIEVE TO BE FAIR, MUTUALLY BENEFICIAL, AND SUPPORTED ENVIRONMENTAL BENEFITS. THE TOWN IS NOW HAVING TO GRAPPLE WITH THE BEST WAY TO DISPOSE OF A NANO CONCENTRATE POLLUTANT AND THE ASSOCIATED COST IMPACTS. LRD IS HOPEFUL THAT THE TOWN MAY BE ABLE TO USE PORTIONS OF A NANO CONCENTRATE AS FEEDSTOCKS FOR THE TOWNS REVERSE OSMOSIS PROCESS AS THIS FULFILLS A SHARED GOAL OF MAXIMIZING THE BENEFICIAL USE OF AVAILABLE WATER RESOURCES. LRD IS ALSO PLEASED THE TOWN IS FINALLY CONSIDERING A PATH TO END DISCHARGING THE TOWN'S REVERSE OSMOSIS CONCENTRATE ALSO IN INDUSTRIAL WASTE INTO THE SOUTHWEST PORT OF THE LOXAHATCHEE RIVER, PORTIONS OF WHICH ARE CONSIDERED IMPAIRED. THE TOWN DESERVES CREDIT FOR THIS INITIATIVE. A LOT OF TIMES PEOPLE REFER TO THEM AS MOBY MAT I THINK THAT'S A PARTICULAR MANUFACTURER VERY FAMILIAR WITH IT EVEN WHEN I WAS PRIOR TO BEING WITH THE TOWN. BUT ESSENTIALLY THE FTEP DOES RESTRICT THE DISTANCE THAT YOU CAN MOVE AND INSTALL THE MATS. THE OTHER THING THAT YOU RUN INTO WITH THOSE MATS IS THAT IT'S ALMOST LIKE YOU'RE CONSTANTLY CHASING THE GRADE AND THE SAND AND HAVING TO GO OUT THERE AND RE-RANK AND MAKE SURE THAT IT IS A LEVEL OR A GOOD SURFACE ON WHICH YOU PLACE THE MATS. THE FTEP IN SOME OF MY PREVIOUS DISCUSSIONS, AND LOOKING AT THOSE ITEMS IS REALLY, IT'S ALMOST THE SAME AS THE CROSSOVERS. THEY WILL ALLOW IT AND THEY WILL PERMIT IT, BUT NOT BEYOND 10 FEET PAST THE VEGETATION. WHERE THE SEA GRAPES IN, YOU HAVE 10 FEET BEYOND THAT, SO YOU'RE PRETTY MUCH LIMITED BEYOND THAT. HOWEVER, IF WE WERE TO MOVE TO A PROGRAM WHERE WE WOULD HAVE AS YOU SAID, THE BEACH WHEELCHAIRS, THAT CAN POTENTIALLY ADD TO THE ACCESSIBILITY OF THE AREA. >> DO THEY HAVE DIFFERENT REGULATIONS OR RULES CONCERNING DIFFERENT FEATURES ON THE EAST COAST OF FLORIDA. I WAS UP IN AUGUSTINE FEW YEARS AGO AND THEY HAD THE MAPS AND I WENT OUT ABOUT PROBABLY ABOUT 150 FEET ONTO THE BEACH AND THEY HAVE A LONG BEACH. THOSE WERE JUST FIELD PERMITS BECAUSE I WAS ONLY ADDING A SHORT DISTANCE TO IT, BUT IT JUST DEPENDS ON REALLY WHAT YOU'RE DOING. IF I'M GOING FURTHER OUT ONTO THE BEACH AND I'M CREATING A LONGER RAMP THAT DOES HAVE TO GO UP TO TALLAHASSEE IN ORDER TO NOT ONLY REVIEW THE ADA PORTION, [01:10:02] BUT ALSO BECAUSE THEY REVIEW IT WITH FWC, AND THEY HAVE ALMOST LIKE A DUAL PROCESS. WHEN I SEND IT TO FTEP, FWC TENDS TO BE THE LONGER POLE IN THE TENT. A LOT OF TIMES THE TOWN TEXTS POSITION THAT THE HOA RULES RUN IN PARALLEL TO THE TOWN'S RULES. SOMETIMES THAT WORKS A LOT OF TIMES IT DOESN'T. A LOT OF TIME AN EFFORT WAS PUT INTO ABACOA HAVING IT PLAY AND HAVING IT ALL FIGURED OUT, HAVING THE VARIETY OF THE DIFFERENT HOMES AND THE COLOR PALETTES AND THE STYLES. SO OTHER MUNICIPALITIES: THE GARDENS, LAKE WORTH BEACH, POINT BEACH, ROYAL PALM, HAVE ALREADY ADOPTED SIMILAR MEASURES. NOW, I BRING THIS UP BECAUSE AS I UNDERSTAND THIS WHEN I READ IT, THAT IT WOULD APPLY TO THE UNINCORPORATED AS WELL AS MUNICIPALITIES THAT HAVE NOT ADOPTED A NOTICE.
