AGAIN, THE CENTRAL ENERGY PLANT EXPANSION IS 6,437 SQUARE FEET, IT IS LOCATED ON THE WESTERN SIDE OF THE EXISTING CENTRAL ENERGY PLANT, AND IS INTENDED TO BE STRICTLY FOR THE CONSOLIDATION OF THE EMERGENCY POWER FACILITIES AND THE GENERATORS FOR THE CAMPUS. SO HERE'S AN EXPANDED VIEW OF THE JUPITER MEDICAL SITE AND THE PROPERTY SURROUNDING IT. THE CENTRAL ENERGY PLANT YOU CAN SEE SOMEWHERE IN THE MIDDLE OF THE SCREEN WITH THE HIGHLIGHTED AREA IS THE PROPOSED GENERATOR EXPANSION. AS I MENTIONED, MOST RECENT APPROVALS LAST YEAR WITH RESOLUTION 4-21 APPROVED THE SURGICAL INSTITUTE, WHICH WAS ROUGHLY 80,000 SQUARE FEET, AND WE JUST RECENTLY HAD THE GROUNDBREAKING FOR THAT CONSTRUCTION PROJECT AND WE ARE ALL VERY EXCITED FOR IT. IT'S GOING TO BRING VERY INNOVATIVE TECHNOLOGY TO THE CAMPUS AND INCREASE THEIR ABILITIES SIGNIFICANTLY. ALONG WITH THAT APPROVAL CAME THE EMERGENCY DEPARTMENT EXPANSION, WHICH WAS JUST TO THE NORTH OF THE SURGICAL INSTITUTE, AND THEN EVEN FURTHER NORTH, A 6,200 SQUARE FOOT ADDITION TO THE CENTRAL ENERGY PLANT. AND THAT ADDITION WAS INTENDED TO ENHANCE THE EXISTING FACILITIES, TO MAKE SURE THAT THERE [00:10:06] WAS ADEQUATE POWER REDUNDANCIES AND ALL OF THE OTHER NEEDS THAT ARE HOUSED WITHIN THAT FACILITY. BRIEF OVERVIEW OF THAT CENTRAL ENERGY PLANT SINCE IT IS [COUGH] APPLICABLE TO WHAT WE'RE DISCUSSING TONIGHT. IT WAS JUST TO THE WESTERN SIDE OF THAT EXISTING CEP. IT IS NOT CONSTRUCTED YET, CONSTRUCTION HAS NOT BEGUN, BUT WE DO EXPECT IT TO BEGIN SOMETIME THIS YEAR. AND IT WAS PLACED IN THIS LOCATION PRIMARILY DUE TO SITE CIRCULATION AS WELL AS THE EXISTING FACILITIES AND THEIR LENDING THEMSELVES TO THIS LOCATION. AS YOU CAN SEE, THIS IS THE APPROVED ADDITION, AND IT WAS ARCHITECTURALLY CONSISTENT WITH THE EXISTING CONFIGURATION, BOTH IN COLOR AND DESIGN AS WELL AS SCALE. MOVING INTO WHAT WE'RE HERE TO TALK ABOUT TONIGHT, THE PROPOSED EXPANSION, AGAIN, JUST TO THE WEST OF THAT APPROVED EXPANSION TO THE CEP HIGHLIGHTED HERE. LOOKING AT A LITTLE BIT CLOSER DETAIL, WE ARE REMOVING APPROXIMATELY 22 SPACES FROM THE EXISTING SECURED ACCESS EMPLOYEE LOT ADJACENT TO THIS FACILITY. I KNOW A NUMBER OF YOU VISITED THE SITE TODAY, THERE IS REDUCED PARKING DUE TO THE CONSTRUCTION, BUT THERE'S STILL AVAILABLE SPACES OUT THERE AND PRIMARILY DUE TO THE HOSPITAL REWORKING SOME OF THEIR FACILITIES, MOVING SOME POST OPERATIVE LABS OFF THE MAIN CAMPUS TO THEIR OTHER AREAS TO REDUCE SOME OF THAT CONGESTION AND REALLY MAKING SURE THAT THE SITE WORKS. WE ARE PROPOSING SPACE FOR FIVE NEW GENERATORS WITHIN THE CENTRAL ENERGY PLANT. ABOUT THREE WILL BE NEEDED INITIALLY AND THEN THERE'LL BE SPACE FOR POTENTIAL FUTURE GROWTH WITH TWO EXTRA GENERATOR SPACES. HERE ARE SOME ARCHITECTURAL RENDERINGS OF THAT ADDITION, AND IT'S, AGAIN, ARCHITECTURALLY CONSISTENT WITH WHAT'S EXISTING AS WELL AS THE APPROVED ADDITIONS. AND OF COURSE WE WILL HAVE APPROPRIATE LANDSCAPING. NOW, THAT IS EXCEEDING THE CODE REQUIREMENTS. THE CODE REQUIRES ABOUT 1,099 SPACES FOR THE PROVIDED FACILITIES. OUR PROPOSED PARKING TOTAL WITH THIS PETITION REDUCES IT BY 22 FOR A TOTAL OF 1,229 SPACES. THAT MAKES SENSE. DID YOU CONSIDER ANYWHERE ELSE BESIDES THIS LOCATION, SOMEPLACE AROUND THE PERIMETER OR THE NORTH LOT WHERE EXISTING EMPLOYEE PARKING? NOW, IS THERE ANYTHING LIKE THAT? BECAUSE THIS IS GOBBLING UP SOME OF THE PARKING AROUND IT. THERE WERE A FEW OTHER LOCATIONS THAT WERE EXPLORED, BUT REALLY LOCATING IT CENTRAL TO THAT CENTRAL ENERGY PLANT WHERE THOSE OTHER FACILITIES ARE CO-LOCATED REALLY MADE THE MOST AMOUNT OF SENSE. THERE'S ALREADY SOME GENERATOR FACILITY IN THE CEP THAT IS AGING AND SO THERE'S INFRASTRUCTURE IN PLACE THAT REALLY LENDS ITSELF TO BEING IN THAT LOCATION CENTRAL TO THE HOSPITAL. WE DIDN'T WANT TO PUT IT TOO CLOSE TO A PERIMETER WHERE IT COULD BE BOTHERSOME TO THE NEIGHBORING PROPERTIES. IT REALLY MADE SENSE IN THIS LOCATION ALL AROUND. THAT DOES MAKE SENSE. I'M VERY FAMILIAR WITH THIS PARKING AREA. I MADE MANY VISITS TO THE EMERGENCY ROOM FOR VARIOUS REASONS. THAT AREA IS EMPLOYEE, BUT IS IT DOCTORS ONLY OR GENERAL EMPLOYEES? IT SEEMS LIKE IT WAS DOCTORS. IT IS GENERALLY DOCTORS. THEY LIKE TO BE CLOSE TO THE HOSPITAL FACILITIES, SO THAT'S USUALLY WHO PARKS THERE. IT IS SECURED ACCESS. SO WAS THERE PLANS TO TAKE SOME OF THE PUBLIC ACCESS AND TURN THAT INTO RESTRICTED ACCESS? IT WAS REALLY ALREADY INCORPORATED INTO SOME OF THE OTHER AREAS OF THE HOSPITAL. SO THERE WAS A PARKING PLAN SUBMITTED AS PART OF THE LAST EXPANSION PROJECT AND THAT ACCOUNTED FOR SOME OF THIS, AND THERE ISN'T ANY EXPECTED IMPACTS TO CURRENT PROPOSED PUBLIC PARKING THAT WOULD HAVE TO BECOME PRIVATE. THE COMPREHENSIVE PLAN CAN BE AMENDED BY THE TOWN AS THEY DEEM APPROPRIATE. AMENDMENTS TO THE COMP PLAN ARE THEN TRANSMITTED TO THE STATE FOR THEIR REVIEW, AND IF THEY DON'T HAVE ANY ISSUES WITH IT, THEN IT CAN COME BACK TO THE TOWN FOR APPROVAL. TO AMEND THE COMPREHENSIVE PLAN, THE AMENDMENT MUST BE BROUGHT BEFORE THE LOCAL PLANNING AGENCIES. THAT'S WHY YOU KIND OF CHANGE YOUR HAT. SO YOU'RE THE LOCAL PLANNING AGENCY NOW AND THEN TO THE TOWN COUNCIL FOR TRANSMITTAL AND APPROVAL. SO EVERY SEVEN YEARS, THE TOWN IS REQUIRED TO DO A EVALUATION AND APPRAISAL REPORT, WHICH IS AN EVALUATION OF THE COMPREHENSIVE PLAN TO REVIEW STATE LAWS THAT MAY HAVE CHANGED SINCE THE LAST COMPREHENSIVE PLAN UPDATE AND TO UPDATE THE PLAN TO MAINTAIN CONSISTENCY WITH ANY OF THESE NEW REQUIREMENTS. THE TOWN IS CURRENTLY UNDERTAKING THAT PROCESS, AND THE MINIMUM REQUIRED FOR THAT PROCESS IS THAT THE TOWN PROVIDE AN EAR NOTIFICATION AND [INAUDIBLE] EVALUATION AND APPRAISAL REPORT IS IS SIMPLY KNOWN AS THE EAR, SO YOU'LL HEAR ME SAY THAT. THE TOWN IS CURRENTLY UNDERTAKING ITS EAR PROCESS AND THE MINIMUM REQUIRED IS A NOTIFICATION LETTER TO THE STATE STATING WHICH AREAS OF THE PLAN WOULD NEED TO BE AMENDED TO MEET ANY STATE REQUIREMENTS THAT CHANGE DURING THAT TIME PERIOD. ONCE THAT PROCESS IS UNDERWAY, THE EAR BASED AMENDMENTS ARE REQUIRED WITHIN ONE YEAR OF WHEN THE NOTICE WENT OUT. SO JUNE 1ST, 2023, THAT'S WHEN WILL BE COMING BACK WITH ANY EAR BASED AMENDMENTS THAT ARE REQUIRED. SO THE PROPERTY RIGHTS ELEMENT, ON JUNE 28TH, 2021, THE GOVERNOR SIGNED HOUSE BILL 59, WHICH REQUIRED EVERY LOCAL GOVERNMENT TO ADOPT A PROPERTY RIGHTS ELEMENT INTO ITS COMPREHENSIVE PLAN. SO THIS IS A NEW ELEMENT ADDED TO THE COMPREHENSIVE PLAN. THE ELEMENT WAS REQUIRED TO CONTAIN VERY SPECIFIC LANGUAGE REQUIRING CERTAIN RIGHTS BE CONSIDERED IN LOCAL DECISION MAKING. [00:40:02] THE ELEMENT IS REQUIRED TO BE ADOPTED PRIOR TO ADOPTION OF ANY OTHER COMPREHENSIVE PLAN AMENDMENTS THAT THE TOWN MIGHT WANT TO DO, WHETHER THAT BE DEVELOPER INITIATED OR INITIATED BY TOWN COUNCIL OR BY STAFF, OR IF THAT DOESN'T OCCUR, THEN THE LATEST IT COULD BE ADOPTED WAS AS PART OF THE EAR BASED AMENDMENTS. SO TO BE PROACTIVE, THE TOWN IS MOVING FORWARD WITH THIS NOW SO THAT IF THE TOWN COUNCIL OR THERE'S ANY REASON TO AMEND THE COMPREHENSIVE PLAN, WE'RE NOT DELAYED BECAUSE WE DON'T HAVE THE PROPERTY RIGHTS ELEMENT IN PLACE. AND THE TOWN COUNCIL IS GOING THROUGH THE STRATEGIC PRIORITIES AND SOMETIMES THAT WILL SPIN SOME COMPREHENSIVE PLAN AMENDMENTS, SO THAT'S WHY WE'RE GOING TO MAKE SURE THAT WE GET THIS DONE EARLIER RATHER THAN LATER. SO THE SLIDE NOW SHOWS THE REQUIRED AMENDMENT LANGUAGE DRAWN STRAIGHT FROM THE STATE STATUTE. I'M NOT GOING TO READ IT, BUT IT WAS IN YOUR STAFF REPORT ALSO. BUT IT MAKES SOME RIGHTS THAT PROPERTY OWNERS HAVE AND IT JUST STATES IT IN A PLACE SO IT'S VISIBLE. IT'S IN THE COMPREHENSIVE PLAN. AS YOU MIGHT KNOW, EVERY LOCAL GOVERNMENT MUST FOLLOW ALL US CONSTITUTIONAL AND STATE CONSTITUTION LAWS RELATED TO PROPERTY RIGHTS. SO YOU'VE ALREADY HAVE THAT LEVEL OF PROTECTION, AND THEN THE FLORIDA STATE STATUTES INCLUDE THE BURT JAY HARRIS PRIVATE PROPERTY RIGHTS PROTECTION ACT, WHICH ALSO PROTECTS PROPERTY OWNERS FROM TAKINGS AND OTHER NEGATIVE IMPACTS FROM LOCAL-- FROM GOVERNMENT ACTIONS. SO THOSE PROTECTIONS ARE IN PLACE. THE NEW REQUIREMENT JUST KIND OF DRAWS YOUR ATTENTION TO THIS AS A SPECIFIC ELEMENT WITHIN THE [INAUDIBLE]. SO AS I SAY IN THE STATE, REQUIRED PROPERTY RIGHTS ELEMENT JUST RAISES AWARENESS OF THE PROPERTY RIGHTS ISSUES REQUIRED BY LOCAL GOVERNMENTS AND REQUIRES SPECIFIC LANGUAGE BE DIRECTLY ADDED TO THE COMP PLAN. WE LOOKED AT TEQUESTA, PALM BEACH GARDENS, THE COUNTY AND A COUPLE OTHERS, AND THEY'VE BASICALLY APPROACHED IT THE SAME WAY WITH JUST TAKING THAT LANGUAGE, BECAUSE THERE'S ALSO A REQUIREMENT THAT THE LANGUAGE IN YOUR PROPERTY RIGHTS ELEMENT CANNOT CONFLICT WITH WHAT THE STATE LANGUAGE IS. PRIVATE PROPERTY RIGHTS ARE IMPORTANT BECAUSE THEY A) INCREASE INCENTIVES FOR PEOPLE TO IMPROVE THEIR STANDARD OF LIVING AND B) THE CONSTITUTION REQUIRES IT. PRIVATE PROPERTY IS FUNDAMENTAL TO HAPPINESS IN EVERY INDIVIDUAL, WHETHER IT'S THE NECESSITIES LIKE FOOD, WATER, SHELTER OR LUXURIES OR TELEVISION OR CAR. THE IMPORTANCE OF PRIVATE PROPERTY CANNOT BE OVERSTATED, AND WITHOUT IT, EVERYONE WOULD BE LIVING IN GOVERNMENT HOUSING USING COMMONLY OWNED PROPERTY, ALL OF WHICH COULD BE REVOKED FOR WHATEVER REASON BY THE RULING CLASS. PROPERTY AND PROSPERITY RIGHTS ARE INSEPARABLE. [INAUDIBLE]--.
